The French version of these terms is the one that is legally binding; the English text below is its translation, the same one the software shows in English.
Terms of use
The text the software shows you when it first opens, which must be accepted to use it. It is reproduced here word for word, so that you can read it before buying.
Version 1.1 — 28 September 2026
This text applies to the PLM management software: clinic, hotel, restaurant, maquis, drinks depot, retail, stock management and school. In the software, the name of the product you bought replaces the general wording. PLM Accounting has its own terms, shown when it opens.
1. Purpose
These general terms of use govern the use of the PLM software, published by PLM ©. They form a contract between PLM © and you, the individual or company installing and using the software. By accepting them, you state that you have the legal capacity to do so, for yourself or for the business you represent.
2. Licence to use
PLM © grants you a personal, non-exclusive and non-transferable right of use, limited to the number of workstations covered by your licence. The software is not sold: it is licensed. You undertake not to copy it for a third party, resell it, rent it out, decompile it or modify it, and not to circumvent the activation mechanism. A licence obtained fraudulently may be deactivated without refund.
3. Additional workstations
An additional workstation licence supplements the main workstation of the same business: it carries, in a tamper-proof way, the licence number of that main workstation. An additional workstation cannot become a main workstation; it works connected to its main workstation, on the same local network, and must reach it at least once every 7 days. For a longer absence (holidays, main workstation switched off), the main workstation can grant, before leaving, a period of 60 days at most, from Admin → Synchronisation. An additional workstation may not be resold, transferred or connected to the main workstation of another business: in that case the connection is cancelled automatically. A business has five workstations at most.
4. Change of computer
The licence is tied to the computer for which it was issued. If that computer breaks down or is replaced, PLM © transfers the licence to the new computer keeping its number: the business’s additional workstations keep working. Transfers are limited to one per twelve-month period and charged 60% of the licence purchase price. Beyond that, a transfer is refused, save with PLM ©’s written agreement. Every transfer is recorded (date, old and new computer, reason). You undertake to stop using the licence on the old computer. Data is not transferred by PLM ©: it is recovered from a backup (article 6) or from an additional workstation of the business.
4a. Required computer
Every workstation, main or additional, must be a computer running Windows 10 or 11 with at least 8 GB of memory (RAM). This minimum configuration is a condition of the licence: PLM © does not install the software on a computer that does not meet it, and does not warrant its operation if it is not met. It also applies to the new computer in the event of a change (article 4).
5. Your data stays with you
The software runs entirely on your own computer. Your sales, your customers, your prices, your till and your accounts are stored on this workstation and, if you switch it on yourself, on the workstations of your local network or in the backup folder you choose. No operating data is sent to PLM © or to any third party, and the software creates no online account. You remain solely responsible for and sole owner of your data, including the personal data of your customers and employees that you enter into it.
6. Backups
The software offers automatic backups and exports. Watching over them is your responsibility. A failed disk, a stolen computer, a reformat or a deliberate deletion cause a permanent loss that PLM © cannot repair, holding no copy whatsoever of your data. You are strongly advised to keep a backup away from the computer (USB stick, external drive, synchronised folder).
6 bis. Encryption and recovery phrase
Your data is encrypted on the disk. Windows opens it every day; on a new computer or after Windows is reinstalled, only the recovery phrase handed to the administrator at installation can open it again. Keeping it safe is your sole responsibility: PLM © never keeps a copy of it and cannot recover it. A lost phrase, when Windows no longer opens the key, means a permanent loss of the data, which PLM © cannot repair. A new phrase can be issued at any time while the computer still works (Admin).
7. Your obligations
You undertake to: enter accurate information; protect the user names and passwords of the accounts you create; grant access only to authorised people; use the software in compliance with the applicable law, in particular in tax, commercial and personal-data protection matters. You are responsible for everything done from the accounts opened on your installation.
8. Accounting and tax
The software is a management tool. It keeps your entries according to the SYSCOHADA chart of accounts and helps you follow your business, but it replaces neither a chartered accountant, nor tax advice, nor your company’s reporting obligations. The documents it produces are drawn from the data you enter: their accuracy depends on yours. It is for you to check that your invoicing complies with the requirements of the tax authority you answer to, in particular as regards standardised invoices.
9. Availability and limitation of liability
The software is provided as is. PLM © does everything possible to make it work correctly, but does not warrant the complete absence of faults. PLM © cannot be held liable for indirect losses — loss of business, of turnover, of customers or of data — arising from the use or the impossibility of use of the software. In any event, and save for gross negligence, any compensation is limited to the amount of the licence actually paid.
10. Support and updates
Support and updates are provided on the terms agreed when your licence was purchased. An update may change or withdraw a feature where this is necessary for the security, the reliability or the compliance of the software.
11. Term and end
These terms apply for as long as you use the software. You may end them at any time by ceasing to use it and uninstalling it; your data then stays on your computer. PLM © may end the licence in the event of a serious breach, in particular infringement or circumvention of the activation.
12. Changes to these terms
These terms may change. A new version will be presented to you when the software opens and will have to be accepted to carry on using it. The text you accept today remains available at any time from Admin → Terms of use, with the date and the name of the person who accepted it.
13. Governing law
These terms are governed by the law of the Republic of Côte d’Ivoire. In the event of a dispute, the parties will first seek an amicable solution; failing that, the competent courts of Abidjan will be seised.
14. Contact
For any question about these terms, your licence or your data, write to PLM © — the contact details appear in Admin → Licence and on your purchase invoice.
